In a BMW there is a Transmission Program Error which makes the car shift into 3rd gear. When the car is stopped and restarted this ends. Happens most times a few minutes into driving the car. Is this due to the Trans, or a Computer, or other? If it was external wiring/electrical problem the "TRANS PRO..." usually would show up right away. YES there is a chance but slight the problem is external.

computer to see specifically what faults are stored.
Additionally, the transmission fluid level and condition should be checked (if low then add, even if full if black and smells burnt then the transmission is toast).
I wish you mentioned the year and series of your BMW. In view of this lack I can only give you generalized comments and nothing specific to your car.

It is true that you might end up replacing the tranny and that diagnosis might be a waste of time and money. Rarely does re-programming works. Rarely does the problem come out to be the shifter switch (but BMW officially had been advocating this for awhile without any guarantee of success). Some people have had success with a new valve body.
But spending big bucks on a new/rebuilt tranny is something that most people do not do easily. If the tranny has burnt oil or slips or sets faults for speed deviation/plausibility... then by all means put in a new tranny.
